ILWU member ordered to stay away from union president after fistfight

The International Warehouse and Longshore Union Local 13 secured a temporary restraining order last week against a union member who engaged in a fight with the chapter president, court records show.

According to the order filed in Los Angeles Superior Court, ILWU President Christopher Viramontes was punched in the face and kneed in the ribs by member Eric Aldape during a July 3 altercation in an alley near the union's San Pedro office.

The restraining order was issued Wednesday, court records show. It orders Aldape to stay away from employees and offices of the ILWU Local 13.

The order shows the fight occurred after Aldape finished serving a six-month suspension in connection with a harassment grievance filed under the union's collective bargaining agreement with the Pacific Maritime Association.

"When I asked him what his issues were, Brother Aldape punched me in the face and hit me directly in the nose," Viramontes' court declaration states. "He then proceeded to attack more. I was able to grab him where it turned into a holding match trying to avoid more punching."

Through a representative, Aldape declined to comment. Gilliam B. Goldberg, an attorney for the union, said in an email that the order was necessary to protect union employees, officers and members.

"The members

of ILWU, Local 13, have the right to express views and opinions of the union and its leadership but they do not have the right to express those views with violence," Goldberg said.

Apparently in connection with the incident, Aldape filed his own allegations with the downtown Los Angeles region of the National Labor Relations Board, records show. The charges were filed on July 11.

According to the NLRB charge, ... "the labor organization, through its officers and agents, physically assaulted Eric Aldape in retaliation for his protected activities."

NLRB lawyers will investigate Aldape's charges and decide whether to bring a case against the union.

Meanwhile, in the civil court case, the ILWU's lawyers are expected to return to court on July 30 to seek an injunction against Aldape, court records show.

SANFORD, Fla. (AP) ? After a year and a half of living as a hermit, George Zimmerman emerged from a Florida courthouse a free man, cleared of all charges in the shooting of 17-year-old Trayvon Martin.

His brother said the former neighborhood watch volunteer was still processing the reality that he wouldn't serve prison time for the killing, which Zimmerman, 29, has maintained was an act of self-defense. Late Saturday night, a jury found him not guilty of second-degree murder and declined to convict him on a lesser charge of manslaughter.

However, with many critics angry over his acquittal, his freedom may be limited.

"He's going to be looking over his shoulder the rest of his life," Robert Zimmerman Jr. said during an interview on CNN.

Demonstrators upset with the verdict protested mostly peacefully in Florida, Milwaukee, Washington, Atlanta and other cities overnight and into the early morning Sunday, but some broke windows and vandalized a police squad car in Oakland during protests in four California cities, authorities said. Additional demonstrations were scheduled across the country through Sunday evening.

Churches also made note of the verdict Sunday morning, with many leaders speaking about the case and urging peace in the aftermath. Some congregants wore hooded sweatshirts, as Martin had when he died, or shirts with the teen's picture.

Martin's killing in February 2012 unleashed debate across the U.S. over racial profiling, self-defense and equal justice. Protesters nationwide lashed out against police in the Orlando suburb of Sanford as it took 44 days for Zimmerman to be arrested. Many, including Martin's parents, said Zimmerman had racially profiled the unarmed black teen. Zimmerman identifies himself as Hispanic.

Six anonymous female jurors considered nearly three weeks of often wildly conflicting testimony over who was the aggressor on the rainy night the 17-year-old was shot while walking through the gated townhouse community where he was staying and where Zimmerman lived.

Jurors were sequestered during the trial, and they deliberated more than 15 hours over two days before announcing late Saturday night that they had reached a verdict. The court did not release the racial and ethnic makeup of the jury, but the panel appeared to reporters covering selection to be made up of five white women and a sixth who may be Hispanic.

In August 2012, defense attorney Mark O'Mara said Zimmerman and his wife, Shellie, had been living like hermits and weren't working because they feared for their safety.

After Saturday's verdict, police, officials and civil rights leaders urged peace and told protesters not to resort to violence. While defense attorneys said they were thrilled with the outcome, O'Mara suggested Zimmerman's safety would be an ongoing concern.

"There still is a fringe element that wants revenge," O'Mara said. "They won't listen to a verdict of not guilty."

Those watching reacted strongly when the verdict was announced. Martin's mother and father were not in the courtroom when it was read; supporters of his family who had gathered outside yelled "No! No!" upon learning of the verdict.

Andrew Perkins, 55, a black resident of Sanford, angrily asked outside the courthouse: "How the hell did they find him not guilty?"

"He killed somebody and got away with murder," Perkins shouted, so angry he shook, looking toward the courthouse.

Trayvon Martin's brother, Jahvaris Fulton, said on Twitter: "Et tu America?" ? a reference to the Latin phrase "Et tu, Brute?" known as an expression of betrayal.

In a Sunday afternoon statement, President Barack Obama called Martin's death a tragedy for America but asked that Americans respect calls for calm reflection.

"I know this case has elicited strong passions," he said. "And in the wake of the verdict, I know those passions may be running even higher. But we are a nation of laws, and a jury has spoken."

The statement reflected the widespread national attention of the case. The White House rarely issues formal responses to trials that do not directly involve the president or federal government.

Obama said the verdict should prompt a discussion on gun violence, but it's unlikely he will use the trial as a way to restart his legislative push for stricter gun control laws. The measures he sought after the December school massacre in Newtown, Conn., failed to pass the Senate.

NAACP President Benjamin Todd Jealous started a petition calling for the Justice Department to open a civil rights case against Zimmerman. "The most fundamental of civil rights ? the right to life ? was violated the night George Zimmerman stalked and then took the life of Trayvon Martin," Jealous wrote in the petition, posted on the website MoveOn.org and addressed to Attorney General Eric Holder.

Martin family attorney Benjamin Crump acknowledged the disappointment of Trayvon Martin's supporters, ranking the teen alongside civil rights heroes Medgar Evers and Emmett Till in the history of the fight for equal justice. However, Crump said, "for Trayvon to rest in peace, we must all be peaceful."

Martin's family maintained the teen was not the aggressor, and prosecutors suggested Martin was scared because he was being followed by a stranger. Defense attorneys, however, said Martin knocked Zimmerman down and was slamming the older man's head against the concrete sidewalk when Zimmerman fired his gun.

Prosecutors called Zimmerman a liar and portrayed him as a "wannabe cop" vigilante who had grown frustrated by break-ins in his neighborhood committed primarily by young black men. Zimmerman assumed Martin was up to no good and took the law into his own hands, prosecutors said.

State Attorney Angela Corey said after the verdict that she believed second-degree murder was the appropriate charge because Zimmerman's mindset "fit the bill of second-degree murder."

"We charged what we believed we could prove," Corey said.

Zimmerman also had some supporters outside the courthouse, including Cindy Lenzen, 50, of Casslebury, and her brother, 52-year-old Chris Bay, who stood watching others chant slogans such as, "the whole system's guilty."

Lenzen and Bay ? who are white ? called the entire case "a tragedy," especially for Zimmerman.

"It's a tragedy that he's going to suffer for the rest of his life," Bay said. "No one wins either way. This is going to be a recurring nightmare in his mind every night."

Before a special prosecutor assigned to the case ordered Zimmerman's arrest, thousands of protesters had gathered in Sanford, Miami, New York and elsewhere, many wearing hoodies like the one Martin had on the night he died. They also carried Skittles and a can of iced tea, items Martin had in his pocket. Obama also had weighed in, saying that if he had a son, "he'd look like Trayvon."

Despite the racially charged nature of the case, race was barely mentioned at the trial.

"This case has never been about race or the right to bear arms," Corey said. "We believe this case all along was about boundaries, and George Zimmerman exceeded those boundaries."

One of the few mentions of race came from witness Rachel Jeantel, the Miami teen who was talking to Martin by phone moments before he was shot. She testified that he described being followed by a "creepy-ass cracker" as he walked through the neighborhood.

Jeantel gave some of the trial's most riveting testimony. She said she overheard Martin demand, "What are you following me for?" and then yell, "Get off! Get off!" before his cellphone went dead.

The jurors had to sort out clashing testimony from 56 witnesses in all, including police, neighbors, friends and family members.

What Different Languages Think Different Animals Sound Like

Hello. Hola. Bonjour. Ni Hao. We all say things differently because each language has their own words. Like, duh. But what about how different languages think animals sound? We're not exactly saying words as much as we are simply enunciating simple sounds and yet, different languages have their own take on each animal sound too.

The video asks people who speak English, Mandarin, French, Italian, Spanish, Turkish, Hindi, Japanese, Russian, Dutch, Bengali, Swahili, etc. how they think a dog, cat, rooster, cow and a pig sound and it's surprising how different it can get. (AP) ? There's a reason why Ryan Howard was limping around the field.

The Philadelphia Phillies' slugger needs surgery to repair a torn meniscus in his left knee and will miss at least six to eight weeks. An MRI on Monday confirmed the tear in his knee. A date for surgery hasn't been set.

"It could have been much more significant damage," general manager Ruben Amaro Jr. said. "We don't want any of our players on the DL. But we know what it is and it's treatable. Hopefully we can get him back in time to play this year."

Howard, the 2006 NL MVP, went on the disabled list Saturday. The three-time All-Star was hitting .266 with 11 homers and 43 RBIs. He was noticeably hobbling during games before he was shut down. He said he continued to play through the pain because he thought he could perform.

"We have to take care of it," Amaro said.

Howard played his first game last season on July 6 after tearing his left Achilles tendon making the final out in the 2011 NL division series. The 33-year-old first baseman has been on a steady decline since signing a $125 million, five-year contract extension on April 26, 2010.

Howard averaged 50 homers and 143 RBIs between 2006-09. He hasn't hit more than 33 or driven in more than 116 runs since then.

Darin Ruf, who hit 38 homers at Double-A Reading last year, replaces Howard. Ruf had been playing left field in Triple-A.

Howard is the latest star player to land on Philadelphia's disabled list. Chase Utley and Carlos Ruiz missed significant time and Roy Halladay remains out after having shoulder surgery.

Backup catcher Erik Kratz had surgery for a torn meniscus on June 12 and already has started a rehab assignment, so he's ahead of schedule.

"Hopefully we will have the same sort of time frame, but everyone's knee is different," Amaro said, comparing Howard to Kratz. "We can only speculate the length of how long it will take to get him to rehab. We'll shoot for the conservative one and hope he comes back faster."

Owners looking for pets spooked by fireworks | Fox 59 News ? fox59 ...

The day after the Fourth of July is considered the busiest day for animal shelters because people are looking for their lost pets. Fireworks spook animals all week, especially on July 4. Many end up running off.

Garnet Ramey visited Indianapolis Animal Care and Control on Friday, looking for English Bulldog, Lucy.

?I?m here to pick up my best friend?s dog, who had a dog-sitter, who accidentally lost the dog last night. The fireworks somehow got her and she got out of the house,? Ramey said.

Ramey was not the only person at Animal Care and Control Friday morning. It was busy as folks waited for IACC?s lost pet tours, which take place every 30 minutes.

?It?s all the same situation. Every one of them (is looking for their pet). (There were) nine of us sitting here,? Ramey said.

Summer is one of the busiest seasons for places like Indianapolis Animal Care and Control. Besides taking in stray dogs and cats afraid of fireworks, they deal with some surrenders and possible overcrowding issues.

?July 5 is traditionally the biggest shelter intake day across the country because so many dogs are scared off by the fireworks,? Dawn Contos said.

Contos is the community outreach coordinator for Indianapolis Animal Care and Control. She said people need to look around their home and neighborhood first, before they visit their facility to look for pets. By the second day, people need to stop by a shelter.

?We tell people (to) please come and look because that?s the worst thing to not know where your pet is,? Contos said.

While Ramey did not find Lucy at IACC, she said she will visit them and other organizations again.

?I hope I don?t have to come back tomorrow. I hope my Lucy is sitting on the porch,? Ramey said.

Indianapolis Animal Care and Control works closely with Indy Lost Pet Alert. The organization compiles lost-and-found reports online. Since they started operating, which was about a year ago, they have reunited people with 2,700 pets.

?This past week alone, we?ve received (more than) 300 lost-and-found alerts. It?s unbelievable how many people are looking for their pets or have lost their pets and a lot of them are reporting them due to fireworks,? Danielle Beck said.

Beck works with Indy Lost Pet Alert. She said she isn?t surprised Indianapolis Animal Care and Control is busy the day after the holiday.

?I?m actually thrilled that the lobby was full here just because that means that people are coming here to look for their pets,? Beck said.

People are urged to check with the animal care and control facility and/or shelter in their county. Every shelter has a different policy on how long they keep animals.

Wedding question: Want to be a bridesmaid? Not for this bride - (Ask Angela )

SALT LAKE CITY, July 5, 2013 ? Dear Angela, A friend of mine got married a year ago, divorced a few months ago, and is already getting married again to this new guy in a few weeks! Crazy.

For her first wedding, she asked me to be a bridesmaid. I accepted the invitation because she?s a dear friend of mine, but the cost of airfare, the bridesmaid dress, alternations on the dress, a gift, and the hotel nearly broke my bank. Surprisingly, she?s having another huge wedding and has asked me to be a bridesmaid again with pretty much all the same expenses included. Now that I?m in school, planning my own wedding and only working part-time, I really can?t afford it to do all of the things that come with being a bridesmaid.

Not another awful bridesmaid dress!

I would just explain my situation to her, but other bridesmaids have dropped out of the wedding party because of the large costs and their choices have really hurt her feelings. She?s been gossiping about them to me, saying she?s cried over the situation and has decided that they probably were never hear real friends to begin with. So much drama.

I?ve been considering biting the bullet and paying for it, but honestly, it just doesn?t work. How can I decline her invitation without being lumped into this ?bad friend? group? I really love her, and this is seriously only about the money.

Wow. Sometimes brides can ?over-bride? a situation, and this sounds like a prime example of that. ?Over-bride? isn?t in the dictionary, but it essentially means to expect anything and everything from the people who know you, and then to get angry with them when they don?t or can?t deliver.

It?s the worst.

In your situation, to really be a good friend, help her to stop ?over-briding.? The reality is she has friends who love her, so they shelled out a bunch of money to be there for her special day. Now she?s having another special day and people can?t afford it. That doesn?t make you guys bad friends, or malicious people, it just means that you have car payments, loans, insurance, and electricity bills just like everyone else.

Be open about your financial situation. You don?t have to be, but it will give her a much needed reality check. Tell her you?re concerned that you might not be the best bridesmaid choice because you wouldn?t be able to participate in X,Y and Z activities because your finances are being allocated elsewhere.

If she?s still unreasonable, tell her how that makes you feel. Wedding or no wedding, as friends, you both have an obligation (and a privilege!) to respect and have concern for each other?s points of view. Hopefully, by engaging in this type of conversation, she will realize that she doesn?t need to throw away years of friendship just because her friends can?t make this grand gesture twice.

Samsung Galaxy S 4 Active (AT&T)


The slightly confusingly named Samsung Galaxy S 4 Active ($199.99-594.99) isn't quite a Galaxy S 4 in a waterproof case. It's a different phone, albeit with the S 4's processor and Android skin. Some of the changes are for the better (a super-loud speakerphone), others are for the worse (a less-capable camera), and yet others are a matter of taste (a different screen technology). Since camera quality is critically important nowadays, I'll say that factor slightly outweighs the others, but I wouldn't be amazed if you judged differently. This is still an excellent Android smartphone.

Physical Features
The Galaxy S 4 Active is a bit thicker than the standard S 4 at 5.5 by 2.8 by .36 inches (HWD). Irritatingly, that seems to make some standard S 4 cases not work because the hole for the headphone jack is in ever so slightly the wrong place; you can fix that by cutting a bigger hole in your case.

I strongly prefer the Active's three physical Menu, Home and Back buttons to the S 4's single Home button and capacitive Menu and Back buttons. Above those buttons, there's a 1080p TFT LCD screen rather than the original S 4's Super AMOLED HD. It appears marginally brighter, but with slightly less saturated colors. The LCD also doesn't use the PenTile pixel arrangement, which bothers some people but which I insist is invisible at a pixel density this high (441ppi.)

The Active comes in gray and turquoise. Our model had a blue back and sides with textured gray plastic panels at the top and bottom of the back. The back appears to have a texture, but that's just an illusion; it's the usual slick Samsung plastic, and it peels right off to reveal the microSD card slot and removable battery.?

The Galaxy S 4 Active is water-resistant and "dust resistant," but not rugged. Although those gray plastic panels are somewhat tougher than the original S 4's back, the screen isn't protected, and it's just as likely to scratch as on the standard S 4. That said, the water resistance is real here. I submerged the Active for half an hour in about eighteen inches of water, and later did camera testing for half an hour in a warm bathtub. The Active didn't leak, but the touch screen became useless under water and for up to a minute after removing it from the water. Because almost all of the Active's features depend on the touch screen, that made the phone pretty useless.

The one exception was the camera. By kicking the camera into "Aqua" mode before you put it in the water, you turn the volume rocker into a shutter button, triggering either photos or videos. That and the power button are the only controls you get underwater.

Voice Calls, Battery and Networking
The S 4 Active is a good voice phone, but not quite as good as the original S 4. I found inconsistent voice quality using the earpiece in a few tests. Sometimes the Audience-powered noise cancellation worked well, sometimes it didn't. Earpiece volume was loud enough for most environments, although the phone vibrated a bit at top volume, something I didn't notice on the regular S 4. The phone has a stunningly loud speakerphone which vibrates the device body noticeably. The speakerphone also has excellent noise cancellation and a nice, warm tone through its microphone. It was easy to activate voice dialing with a Plantronics Voyager Legend Bluetooth headset, but Samsung's S Voice had trouble recognizing some names for dialing.

The Active's 2600mAh battery is the same as the Galaxy S 4's, so you should get the same talk time. I can't explain why I got such spectacular battery results here, with 16 hours, 41 minutes of talk time and 5 hours, 41 minutes of video streaming compared to the ordinary S 4's 10 hours, 50 minutes of talk time and 4 hours, 48 minutes of streaming. You should expect similar battery life here to the HTC One on AT&T.

Speeds on AT&T's 4G LTE network were also blazing. AT&T's network is the fastest in the USA, and we got awe-inspiring speeds of 14-18Mbps down and 6-8Mbps up in Manhattan. The phone will work on AT&T's network here in the US; it will also roam to foreign HSPA+ networks. Other connectivity includes 802.11 a/b/g/n/ac Wi-Fi on the 2.4 and 5GHz bands, Bluetooth 4.0, NFC and a GPS chip that locks in very quickly and accurately.

Software and Performance
Here's where the S 4 Active is most similar to its sedentary cousin. Just like the ordinary S 4, the Active runs Android 4.2 with Samsung's additions on a 1.9GHz Qualcomm Snapdragon 600 processor, making it the fastest phone on the market right now. Benchmark scores were similar to the S 4, except for a little hiccup where it was imperceptibly slower to toggle Bluetooth on and off.

In summary, there's a massive jumble of ideas here: great ones like customizable call audio, split-screen multitasking and a built-in pedometer; so-so ones like a slightly sluggish IR remote control; and unreliable ones like Smart Scroll, which is supposed to let you scroll pages by tilting your head.

As I said in the original review: It's like Microsoft Office, in that it's packed with features. But you know what? People love Microsoft Office, because everybody finds what they need in it, and they don't all find or need the same things. The Samsung Galaxy S 4 has a million ideas and needs to share all of them, right now, and it doesn't matter if five of them are ridiculous because you're going to think the next five are brilliant.

Andrew Wiggins On Path to No. 1 Pick in 2014 NBA Draft

In roughly one year, soon-to-be NBA commissioner Adam Silver will step up to the podium and announce Andrew Wiggins, a forward from Kansas, as the No. 1 overall pick in the 2014 NBA draft.

Wiggins is one of the best high school prospects of all time, and there?s no question that he?s going to make a big impact with the Jayhawks next season. The Huntington Prep product from Ontario has dominated every single high school player who has tried to slow him down. He?s a remarkable talent and could be the next LeBron James.

While Wiggins has yet to even play a game of collegiate basketball, everyone is drooling all over him?and for good reason. Wiggins is a 6'8" forward who can play three positions, score from nearly anywhere on the court, dunk over any opponent and put his team on his back each and every night.

Kansas may not have the best recruiting class in the nation?that title goes to Kentucky?but Bill Self got himself the top prospect in the country. Wiggins will likely only stay in college for one year and then enter the draft, but it?s going to be one special year for the Jayhawks basketball program.

The Jayhawks should take care of all of the teams in the Big 12 and head into the NCAA tournament as favorites, with Wiggins leading the way. He will definitely be in the conversation for National Player of the Year and could take home a national championship as well.

Kansas has only had one No. 1 overall pick in the program?s history?Danny Manning back in 1988. Wiggins is bound to be the second Jayhawk to go first and also the second Canadian-born player as well, as pointed out by Michael Lee of The Washington Post:

This year?s draft wasn?t filled with as much talent as there is expected to be next year, and most of the hype surrounds the incoming freshman class. As Chad Ford of ESPN writes (subscription required), Wiggins is one of seven potential freshman lottery picks for 2014, which would tie the record set in 2008.

While Nerlens Noel, Anthony Bennett and Alex Len were all talented prospects, among others, the 2013 draft class was very weak. Alex Kennedy of USA Today made a suggestion as to what Wiggins should have done last Thursday night?hinting that Wiggins is much more talented than anyone who just got drafted:

Wiggins is a very unique player, as he doesn?t really acknowledge the attention he gets. As Eric Prisbell of USA Today writes, Wiggins wasn?t even aware that basically everyone in the country was watching him and that many coaches were recruiting him to go to a variety of top schools.

It?s expected that Wiggins will be able to handle the pressure. Sure, he?s going to an enormous basketball school and fans will be packed into Allen Fieldhouse to watch his every move, but he's done a good job of being a model player thus far. He admires Kevin Durant because of how he acts on and off the floor, per Prisbell. If he responds to his stardom in a similar fashion, Wiggins will be fine at Kansas.

We already know what he?s capable of doing on the court, and he will quickly prove to scouts that he?s worthy of the No. 1 pick. Ford writes that he hasn?t come across a scout or general manager who doesn?t think Wiggins is the top prospect for the 2014 draft. That speaks to how talented the forward truly is.

Wiggins will be a star at Kansas and will be the first overall selection in the 2014 NBA draft. It may seem crazy to say that this early, and while Wiggins has zero experience in college, he deserves all of the hype. He?s earned it.
